Terms and Conditions (AGB)

The following Terms and Conditions govern the services provided by CW Jagdkontor GmbH (hereinafter also referred to as “CW Jagdkontor”, “we” or “the Company”) in acting as an intermediary for international hunting safaris and related travel arrangements. By booking a hunting safari or related tour through CW Jagdkontor GmbH, you (the client) agree to these Terms and Conditions. Please read them carefully before booking. These Terms outline the contractual relationship between you and CW Jagdkontor GmbH as the booking agent. The actual safari and travel services (the “safari program”) are provided by independent outfitters or tour operators, for whom CW Jagdkontor acts only as an agent.

1. Scope and Role of CW Jagdkontor GmbH

CW Jagdkontor GmbH operates as a booking agency (intermediary) for hunting safaris and related travel services offered by third-party partners (such as Uganda Wildlife Safaris Ltd. and other outfitters in Africa). The contract for the performance of the safari (including guiding, outfitting, accommodations, hunting activities, and other on-site services) is between you and the respective outfitter or service provider. CW Jagdkontor’s role is to facilitate and arrange your booking. While we carefully select our partners and will convey all bookings and payments to the relevant outfitter, CW Jagdkontor is not itself the provider of the safari services and is not liable for the actual fulfillment of the hunting tour by the outfitter. Any claims related to the execution or quality of the safari services must be addressed to the responsible outfitter. These Terms and Conditions, however, apply to and govern the booking process and the relationship between you and CW Jagdkontor GmbH. They do not override any terms and conditions that the actual service provider may have; you may be required to sign a separate safari participation contract or liability release with the outfitter before the commencement of the hunt. CW Jagdkontor will inform you of any such requirements during the booking process.

2. Booking and Formation of Contract

A booking request for a safari or tour can be made in writing (including via email or an online form) or through any other text-based method. By submitting a booking request, you are making an offer to enter a contract with CW Jagdkontor GmbH for the arrangement of the safari. The booking (and resulting mediation contract with CW Jagdkontor) is considered confirmed and binding only after CW Jagdkontor GmbH issues a written booking confirmation to you, and the required deposit (see Section 3 below) has been received. Until both conditions are met, CW Jagdkontor reserves the right to refuse or not confirm a booking request. We strive to process bookings promptly. If you do not receive a confirmation within a reasonable time, please do not hesitate to contact us.
In some cases, you may also be required to complete and sign additional documentation (such as a safari contract or liability waiver from the outfitter, or a release of liability form) as a condition of the booking. CW Jagdkontor will provide you with such documents if applicable. Please note: Failure to sign the required participation or liability forms as requested can result in cancellation of your trip, in which case the cancellation provisions of Section 4 will apply.

3. Reservations and Payments

To secure and confirm a safari booking, a deposit of 50% of the total safari price (or, if applicable, the amount specified in the specific safari offer or payment schedule) is required upon booking. No binding contract for the safari arrangement will come into effect until the deposit has been paid in full and accepted. The timely payment of the deposit is essential – failure to remit the deposit by the date indicated in your booking offer or invoice may result in the release of your reserved hunt dates or safari slots. Only upon receipt of the deposit by CW Jagdkontor and our written confirmation to you of such receipt will your reservation be secured and confirmed.

Unless otherwise agreed, all payments shall be made in United States Dollars (USD). Payment instructions (including bank transfer details or other accepted payment methods) will be provided with your invoice. Please note that any bank charges or transfer fees are your responsibility. Personal or cashier’s checks are accepted for the initial deposit only (and must clear our account to be considered received); the balance must be paid via bank transfer or other guaranteed funds. We do not accept responsibility for cash sent through the mail.

The remaining balance of the safari price (i.e., the amount not covered by the deposit) is due no later than 90 days before the scheduled start date of your safari, unless a different deadline is specified in your booking agreement. If a booking is made within 90 days of the safari’s start date, the full price is payable immediately upon confirmation. Important: If the balance is not paid by the due date, CW Jagdkontor (on behalf of the outfitter) reserves the right to treat the booking as canceled by you, in which case cancellation fees may apply (see Section 4). Once full payment has been received, we will promptly send you any necessary travel documents, vouchers, or contact information for your trip.

4. Cancellations, Changes, and Refunds

Cancellation by the Client: If you wish to cancel your safari booking, you must do so in writing (e.g., by email). The date of receipt of your cancellation notice by CW Jagdkontor will determine the applicable cancellation charges. Please note that the initial deposit of 50% is non-refundable in all cases, as it is used to secure your spot and make necessary arrangements with the outfitter. For cancellations made 90 days or more before the safari start date, any amount paid above the 50% non-refundable deposit will be refunded to you. For cancellations made less than 90 days before departure, up to the full safari price may be charged as a cancellation fee. The closer the cancellation is to the departure date, the higher the cancellation fee, potentially up to 100% of the safari cost, because at that late stage, it is often impossible to find a replacement, and most safari expenses have already been incurred. We will endeavor to minimize cancellation costs. In some instances, unused portions of trips may be credited for future use at our discretion or according to the outfitter’s policies, but this is not guaranteed. We strongly recommend that you obtain travel cancellation insurance (see Section 7) to protect against unforeseen circumstances that may require you to cancel.

Changes by the Client: If you request changes to your confirmed booking (such as shifting dates or altering the itinerary), CW Jagdkontor will work with the outfitter to accommodate your request. However, changes are subject to availability and feasibility. Minor changes may be made at our discretion without charge. However, significant changes (for example, moving the safari to a different year or changing the destination) may be treated as a cancellation, and a new booking will be required. Any additional costs resulting from changes (e.g., different seasonal pricing, rebooking fees imposed by the outfitter, or administrative fees) will be communicated to you and must be agreed upon before the changes are confirmed.

Cancellation or Modification by the Outfitter/Company: CW Jagdkontor GmbH and our partner outfitters reserve the right to cancel or significantly alter a safari in rare cases of necessity. Such reasons may include (but are not limited to) unexpected hunting area closures, political instability, natural disasters, epidemic outbreaks, or the outfitter’s inability to operate the trip safely as planned. Suppose we or the outfitter must cancel your safari before it begins. In that case, you will be offered the choice of either (a) accepting an alternative, comparable safari (if available) or (b) receiving a full refund of payments made for the safari. We will not cancel a safari less than 30 days before departure except for reasons of force majeure (see Section 6) or the client’s failure to pay the balance.

If it becomes necessary for the outfitter to modify the itinerary or arrangements during the safari (for example, due to sudden changes in animal migration, weather, or safety concerns), we appreciate your understanding. Hunting in remote areas can be unpredictable. The outfitter will make reasonable efforts to provide arrangements of equivalent quality and interest. No refund will be given for changes to the itinerary that do not significantly diminish the overall safari experience; if a substantial portion of the services cannot be provided as booked, the outfitter will, if possible, arrange for appropriate alternatives or offer a reasonable refund for unfulfilled services, as dictated by the circumstances.

No-Shows: If you fail to join your safari or leave before its completion (for any reason, including illness or personal choice), no refund will be made for unused services.

Notice: CW Jagdkontor’s role in cancellations and refunds is that of an agent between you and the outfitter. We will administer any refunds or credits due under these Terms in line with the outfitter’s policies. Refunds for payments made to CW Jagdkontor will be issued to you only after we have recovered the respective amounts from the outfitter or relevant service providers. Any bank fees or exchange rate differences incurred during the refund process will be the client’s responsibility.

5. Assumption of Risk

Inherent Risks of Safari: Please be aware that hunting safaris and wilderness tours inherently involve certain risks and dangers. These include, for example, risks of wild animal encounters, rugged terrain, variable weather conditions, and the general remoteness of locations, as well as risks associated with travel in developing regions (such as limited medical facilities). By booking and participating in a safari arranged by CW Jagdkontor, you acknowledge and accept all such risks. You confirm that you are in suitable physical condition for the planned activities and will seek medical advice if needed before traveling. It is your sole responsibility to obtain any recommended or required immunizations, medications, or medical advice related to travel in the destination country (e.g., malaria prophylaxis, yellow fever vaccination, etc.). We strongly advise consulting a travel medicine specialist well in advance of your trip.

Liability for Personal Injury or Property Damage: CW Jagdkontor GmbH cannot be held liable for any personal injury, illness, death, or property damage or loss that may occur during or as a result of the safari or any related activities. This exclusion of liability applies to any such incidents, however caused, except to the extent that they are caused by our own gross negligence or willful misconduct. The independent outfitters and guides operating your safari have their liability policies and terms; any claims arising from incidents in the field should be directed to the relevant outfitter or guide. You will be required to sign a separate liability release or assumption of risk agreement with the outfitter before commencing the hunt, which will further detail the inherent dangers of the activity and the liability limitations. Refusal to sign such documents may result in your exclusion from the safari without compensation (see Section 2).

By embarking on the safari, you also agree to follow all safety instructions and guidelines given by the professional hunters, guides, or staff. This includes instructions on firearm handling, proximity to wildlife, and conduct in camp. Failure to adhere to safety protocols can result in severe injury or death, and in such cases, CW Jagdkontor and the outfitter shall not be liable for the consequences. You assume full responsibility for any damages or losses resulting from your own negligence or willful disregard of rules or guidance.

6. Force Majeure

CW Jagdkontor GmbH shall not be liable for any failure to perform, or delay in performing, any of our obligations (or those of our partner outfitters) under these Terms if such failure or delay is caused by force majeure. Force majeure means any event or circumstance beyond the reasonable control of the Company or the outfitter, which could not have been avoided even with all due care. Such events include, but are not limited to: natural disasters (e.g. floods, earthquakes, hurricanes or other extreme weather events, fire, or other acts of nature), acts of God, war, invasion, hostilities or warlike operations (whether war be declared or not), civil unrest, riots or insurrections, terrorist activities or threats, government orders or regulations (including travel bans or border closures), strikes, labor disputes or lockouts, epidemics, pandemics or quarantine restrictions, sudden changes in laws or government policies, embargoes or blockades, significant logistical or supply chain disruptions, or other extraordinary events making the fulfillment of the trip dangerous, impossible, or impracticable.

In the event of a force majeure situation, we will inform you as soon as reasonably possible and will take all reasonable measures to minimize the impact on your safari. Depending on the situation, it may be necessary to delay, reschedule, or cancel the safari. If a trip is delayed or postponed due to force majeure, it will not be considered canceled by CW Jagdkontor. Instead, we will endeavor to offer you an equivalent safari at a later date or apply the payments you have made as a credit toward a future trip. Such rescheduling will be subject to availability and discussed with you. If a trip must be canceled entirely due to force majeure before commencement, we will attempt to recover from the outfitter any refunds or credits to which you are entitled under the outfitter’s terms. We will then pass those on to you (minus any unrecoverable costs already incurred on your behalf).

Please note that any additional expenses incurred by you due to a force majeure delay or interruption are not the responsibility of CW Jagdkontor or the outfitter. This includes, for example, costs of additional accommodation, meals, local transportation, flight change fees or lost tickets, visa fees, personal gear purchases, or any other incidental expenses, as well as any loss of enjoyment or vacation time. We strongly recommend that you obtain travel insurance that covers trip delays or cancellations due to such unforeseen events (see Section 7). Once a safari is underway, no refunds will be issued for interruptions or changes due to force majeure or other reasons beyond the control of CW Jagdkontor and its partners. We will, of course, make every effort to assist you in such situations — for instance, helping with rearrangements or providing documentation for insurance claims — but we ask for your understanding that these events are genuinely beyond our control.

7. Travel Insurance and Liability Limitations

Travel Insurance: Given the significant investment and inherent risks involved in international hunting travel, comprehensive travel insurance is highly recommended for all clients. Such insurance should ideally cover trip cancellation or interruption, medical expenses (including emergency evacuation and repatriation), personal accident, loss or damage of baggage, firearms, or equipment, and personal liability. It is the client’s responsibility to obtain insurance coverage in an adequate amount for the duration of the safari and any related travel. Please review any policy carefully to ensure it covers the specific activities (e.g., hunting with firearms, dangerous game hunting, etc.) and destinations of your trip. CW Jagdkontor GmbH will gladly provide, upon request, a confirmation of booking or other documentation needed for securing travel insurance or for making an insurance claim. However, we do not arrange insurance for our clients and do not provide coverage for their risks ourselves. Any insurance claim is between you and your insurance provider.

Limitation of Liability: To the maximum extent permitted by law, CW Jagdkontor GmbH’s liability for damages is limited. In particular, CW Jagdkontor (acting as an intermediary) is not liable for the actual provision of travel or hunting services, which independent outfitters or third parties perform. We are responsible for making the booking arrangements correctly, conveying information accurately between you and the outfitter, and ensuring our statements and conduct are accurate and in line with our standards. We accept liability for loss or damage arising directly from our own negligence or willful misconduct in the performance of our intermediary duties, but in no case shall our liability exceed the total amount of the commission or fee we received for arranging your safari. We are not liable for any indirect, consequential, or punitive damages.

CW Jagdkontor is also not liable for circumstances outside of our control (including force majeure events as described in Section 6 or acts or omissions of the outfitter or other third parties). Suppose the Montreal Convention or other international conventions apply to any travel arrangements (such as flights or air carriage) in connection with your safari. In that case, our liability (if any) is limited by the provisions of those conventions. Nothing in these Terms shall limit or exclude any liability which cannot be limited or excluded under applicable law, such as liability for personal injury caused by our gross negligence or unlawful intent.

Indemnification: You agree to indemnify and hold harmless CW Jagdkontor GmbH, its directors, employees, and agents from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) that we incur as a result of your breach of these Terms or your negligence or misconduct during the safari. For example, if you cause damage to property or injury to a third party on the trip, and CW Jagdkontor is held responsible or incurs costs as a result, you agree to reimburse us for those costs.

8. Governing Law and Jurisdiction

These Terms and Conditions and any agreements to which they apply (and any dispute, controversy, or claim arising out of or in connection with them or the services provided) shall be governed exclusively by the laws of the Federal Republic of Germany, without regard to its conflict of law principles. In cases where the client is a consumer (as defined by European or German law) and has their habitual residence within the European Union, this choice of German law applies only to the extent that it does not deprive the consumer of mandatory protections afforded by the law of their country of residence.

The place of performance of the services by CW Jagdkontor is Ostbevern, Germany. To the extent permissible, the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms or any safari bookings made with CW Jagdkontor GmbH shall be the courts of Münster, Germany.

Notwithstanding the foregoing, if you are a consumer and not contracting as a business, you may also bring claims in the courts of your country of residence. Additionally, CW Jagdkontor reserves the right to initiate legal proceedings in the courts of your place of residence if necessary. The provisions of this section do not limit any applicable statutory rights regarding venue or applicable law that cannot be waived by agreement.

9. Severability Clause

Suppose any provision of these Terms and Conditions is found to be invalid, illegal, or unenforceable by a court or competent authority. In that case, that provision shall be deemed severed from the remaining terms, and the validity and enforceability of the other provisions shall not be affected. In place of the invalid or unenforceable provision, a valid provision that comes closest to the economic intent and purpose of the original provision shall be deemed to be agreed. The same applies if these Terms are found to contain an omission or gap: a provision shall be deemed to be agreed that corresponds to what would have been the intention of the parties had they considered the matter from the outset.
